Additional Transfers & Development Plans


1. Addition 1 To 2 Floors

Q : My house is a 1 Storey Terrace House type. Can I extend my house to 2 floors?​
​A:
The Council has no objections for the proposal of the owner of a 1-storey terraced house to increase to 2 storeys. This is because on 16 December 2011, the Council approved a proposal paper for the setting of policy regarding the application to increase the floor from a 1-storey terrace type residential house to 2 storeys in the 23rd Local Committee Meeting of the Year 2011 Session 2010/2011 (23/2011).
However, there are conditions that must be met by the applicant before the proposal can be approved by the Council.​

2. Addition to the Building Shift Area

Q : My house is a 2-storey semi-detached house. Can I add to my house within the building displacement area?​
​A:
The owner of a Semi-detached house can make an addition in the displacement area with the following conditions:
Need to leave a minimum distance from the lot boundary line (fence) to:​

​Notes:
The owner needs to submit a letter of appeal first before submitting an additional application for amendments to get comments through a sketch of additional proposals that the owner wants to make.
The owner will be charged an additional fee (fine) 10 times the process fee for the addition of new space that enters the building displacement area.

 
3. Additional Partition Walls In Commercial And Industrial Buildings

Q :

Why does the addition of a partition wall require a Temporary Building Permit?​

​A :

According to Sections 79(1) & 79(4) of the Roads, Drains & Buildings Act (Act 133) A person who builds any barriers, plots, roofs, ceilings and so on must first obtain written permission from the local authorities.

4. Gazebo Addition

Q : Why do I need to get approval for a portable structure like a Gazebo?
​A : According to Section 80 of the Roads, Drains & Buildings Act (Act 133) Any Mobile Shed may not be built without permission and may be fined RM 1000.00 if convicted or compounded RM 500.00 if he fails to comply with the instructions.​

 

5. Awnings Installed In The Back Alley
Q : Why can't I install a vent in the back alley? The back of my shop is often wet from rain.
​A : Pursuant to Section 69(3) of the Roads, Drains & Buildings Act (Act 133) No person shall build or permit to build any obstruction in or over any back lane, and the local authority may, where such obstruction exists, lower and removing the obstruction and the costs and expenses of lowering or removing the obstruction may be claimed from the person who built the obstruction.​

 

6. Awning Material Type 'Metal Deck'​

Q :

Why can't my shop use an awning that uses metal deck material?

A : Awnings of the 'metal deck' type are not allowed to be set up in areas that project into public areas such as pedestrian areas, or area to place table chairs. Only adjustable awnings are allowed to project in public areas. However, permanent hoods are allowed to build as long as it is within their own area.​

 

7. Installing Security Fence 'Hoarding' Before Building Plans Are Approved​n

Q :

Can I install a security fence once I have Planning Permission? Approval of Building Plans may take a long time and it is likely that the site will be encroached upon before earthworks begin on site.​

​A​ :

Security fences are only permitted after obtaining Planning Permission and Building Plan Approval.​

 

8. Additional Partition Walls In Commercial And Industrial Buildings

Q :

I have a 2-story terrace-type residential house (middle lot). I intend to build a balcony on the front of the upper floor of my house. Can I do that?​

​A:

The owner is allowed to build a balcony on the front of the upper floor in place of the 'porch' roof with the following conditions:

  1. Submitting a letter of appeal to the Council by showing a sketch of the additional proposal to be made.
  2. Obtaining the consent of adjacent neighbors for changes to the shared roof (the owner must be fully responsible if there is damage to the neighbor's house during the renovation works)​.

Note:
The application to build a balcony is not allowed to use the Standard Plan Book but must be submitted through an appointed Consultant.​

 

9. Proposal for the Construction of a Bungalow House on a Sloping Site​

Q :

I plan to build a bungalow house but the proposed site is high and sloping. Can I build on a site like this?

​A :

A bungalow house stand can be built on any site but sloping sites have high risk potential. However, if the appointed Consultant has prepared the design and the Engineer has certified the strength of the structure and provided effective measures to treat sloping areas such as retaining walls, then the Council has no obstacle to approve the proposed plan,

The appointed consultant must submit the ground work plan (if it involves cutting and filling) and the retaining wall plan to the Engineering Department before the building plan is submitted to the Building Department. The letter of support from the Engineering Department must be attached together with the building plan when it is submitted.

 
10. Construction Of Fence On The Border Line With The Neighbor's House

Q :

Why do I need to get a neighbor's approval to build a fence at my house? The fence wall is in my own house and does not involve the neighbor's house.​

​A :

Owners who intend to build a fence to replace the existing fence provided by the Developer must comply with the following:​

  1. Obtain the consent of adjacent neighbors (if applicable)
  2. Obtaining a Permit to Place Building Materials​
  3. Obtaining Roro Bin Services if breaking works are involved.​
  4. The maximum height of the fence wall is 1.5M (5'0")​
  5. Provide a minimum of 40% openings in the wall to allow ventilation and lighting.
  6. Both sides of the wall should be plastered and painted on both sides.
  7. Ensuring that building materials @ waste building materials do not cause disturbance to adjacent neighbors.​

 
11. Addition of 'Awning' on the Edge Using the Equivalent Plan Book.

Q :

I would like to make a modification but it does not involve breaking work. Remodeling only involves adding walls to the kitchen and interior work only. Can I get an exemption from getting Tong Roro​ service?

​A :

The Equivalent Plan Book can only be used for 1 or 2 storey terrace type residential houses (middle lot 'intermediate') only. Apart from what is provided in the Equivalent Plan Book, it is necessary to obtain the services of an appointed Consultant (Architect @ Registered Draftsman)​.


12. Exceptions for​ Tong Roro Service

Q :

I plan to install an awning on the side of a 2-storey terrace house (corner lot) / 2-storey semi-detached house. Can I get approved by using the Equivalent Plan Book?​​

​A​ :

Owners who wish to apply for an exemption must first submit an appeal stating the type of addition they wish to make through a sketch on the floor plan.
